Terms of Service

By creating an account, accessing, or using TrainerDNA, you agree to be bound by these Terms and any additional terms referenced here. If you do not agree, you may not use the Service. If you use TrainerDNA on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

TrainerDNA is an AI-powered growth workspace for online fitness coaches. It helps coaches organize content strategy, track connected social platform performance, collect client proof, manage client follow-up workflows, review Google Calendar events, refine offers, and receive AI-generated growth recommendations. Features may change, expand, or be removed during the beta period.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the information you provide, for keeping credentials confidential, and for all activity under your account. Notify us promptly at tandemdnamarketing@gmail.com if you suspect unauthorized account access.

TrainerDNA is provided during an active beta period. The Service is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free, secure against every threat, or that data including analytics, follower counts, calendar events, social metrics, or AI-generated insights will be complete, accurate, or current at any given time.

You agree not to use TrainerDNA to:

• Violate any applicable law, regulation, or third party rights.
• Upload or transmit harmful code, malware, or infringing content.
• Harass, abuse, exploit, or harm any person, client, or prospect.
• Reverse engineer, scrape, overload, or attack the Service.
• Attempt to bypass security, authentication, or rate limits.
• Use the Service to send unsolicited messages, spam, or unlawful promotions.
• Misrepresent your business, credentials, results, pricing, or client outcomes.

TrainerDNA can connect to third-party platforms, including Google Calendar, TikTok, Instagram, Facebook, YouTube, and Stripe, only after you authorize the connection through the relevant provider's OAuth or connection flow. When you connect an account, you grant TrainerDNA permission to access the approved data scopes solely to provide the features you requested.

You may disconnect third-party accounts from TrainerDNA at any time. Your use of those platforms remains subject to their own terms and policies. TrainerDNA is not affiliated with, endorsed by, or sponsored by TikTok, Meta, Instagram, Facebook, Google, YouTube, Stripe, Supabase, Resend, Anthropic, or any other third-party platform unless explicitly stated.

You are responsible for complying with all rules that apply to the platforms you connect or publish to, including TikTok, Instagram, Meta, Google, YouTube, and Stripe policies. TrainerDNA does not publish, upload, delete, comment, message, or modify TikTok or Instagram content in this version. If a future feature requests publishing or management permissions, that feature will require your separate authorization.

TrainerDNA is a business operations and growth tool for coaches. It is not medical advice, healthcare advice, nutrition therapy, mental health advice, a medical device, a medical record system, or a HIPAA-covered service. You should not use TrainerDNA to diagnose, treat, monitor, or manage medical conditions.

Do not upload protected health information or other regulated health data unless you have confirmed that doing so is lawful, have obtained all necessary consents, and accept responsibility for that use. You are responsible for any coaching, fitness, nutrition, or health-related advice you provide to your clients.

You are responsible for having all rights, permissions, and lawful bases required to enter client or prospect information into TrainerDNA. This includes contact details, check-in notes, progress photos, testimonials, transformation stories, messages, and any other proof content. You must not upload client content or use testimonials unless you have the required consent from the individuals involved.

TrainerDNA is currently free to use during beta unless we present paid plan terms to you. If paid plans are introduced, applicable fees, billing cycles, cancellation rules, and refund terms will be shown before you subscribe. Payments and payment processing are handled by Stripe and are subject to Stripe's terms. We do not store full payment card details on our own servers.

TrainerDNA uses artificial intelligence to generate growth suggestions, content ideas, scoring, pricing guidance, and other recommendations. These outputs are informational only. They are not professional, legal, financial, medical, or business advice. AI outputs may be incomplete, inaccurate, or unsuitable for your situation. You are solely responsible for reviewing outputs and for decisions about your business, clients, offers, pricing, and published content.

We do not guarantee revenue, leads, client acquisition, retention, conversions, follower growth, engagement, business growth, health outcomes, or any other specific result. Examples, benchmarks, case studies, scores, and recommendations are illustrative and are not promises of similar outcomes.

You retain ownership of content, materials, client information, and other data you submit to TrainerDNA (“Content”). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit your Content solely as needed to operate, maintain, secure, support, and improve the Service for you.

The TrainerDNA name, brand, software, design, copy, and underlying technology are owned by Tandem DNA Marketing LLC or its licensors and are protected by intellectual property laws. These Terms do not transfer any of our intellectual property to you. You may not copy, modify, distribute, sell, or create derivative works of the Service except as expressly permitted by us in writing or by applicable law.

You may stop using TrainerDNA at any time and may request account deletion by emailing tandemdnamarketing@gmail.com. We may suspend or terminate access if you violate these Terms, misuse the Service, create risk for users or third parties, or if we are required to do so by law or platform policy. After termination, we may delete or anonymize associated data as described in our Privacy Policy and data deletion instructions.

To the fullest extent permitted by applicable law, Tandem DNA Marketing LLC and its affiliates, officers, employees, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of TrainerDNA. To the extent liability cannot be excluded, our total aggregate liability is limited to one hundred U.S. dollars (US$100) or the amount you paid us for the Service in the twelve months before the claim, whichever is greater.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Subject to any non-waivable rights you may have under applicable law, the state and federal courts located in New York will have exclusive jurisdiction over disputes arising from or related to these Terms or the Service.

We may update these Terms from time to time. When we do, we will update the “Last updated” date and, where appropriate, notify you in the Service or by email. Continued use of TrainerDNA after changes take effect constitutes acceptance of the updated Terms.
